Determining Child Support & Alimony
The state of Utah has specific guidelines that determine the correct amount of child support that should be paid in order to ensure that your child receives proper care. Both parents carry the responsibility for financially supporting the child until age 18.

Calculating Child Support
Child support orders are based on statutory guidelines. The court also considers several factors when determining a fair child support amount, including:
- The incomes of both parents
- The child custody arrangement
- Any special needs of the children or parents
You can request a modification of child support if circumstances change over time. If you lose your job or either parent has a change in income, you may be able to request a modification. However, it is important to request the change as soon as possible because any modification can only be backdated to the date of the request, not the date of the change in circumstances.
How Is Alimony Determined?
The initial alimony settlement is based on the circumstances that existed at the time of your divorce. Factors considered when determining alimony include:
- Ability to pay
- Financial need of the recipient
- Both spouses’ earning capacity
- Length of marriage
- Child custody
A significant change in circumstances can result in a modification of alimony. Remarriage and cohabitation can impact alimony awards so it is important to be open and honest about your current and future living arrangements with your attorney.
