Probate is the legal process by which a person's estate is gathered, debts paid, and assets are distributed after her or his death. Estate Administration includes the probate process as well as non-probate transfers of the deceased's assets. Without a Will, individual state laws direct the probate court how to distribute the deceased's estate. To avoid the state controling the distribution of your estate, a will is necessary so that your wishes may be carried out. And, if you are divorced, injured, or disabled, a will or other estate planing is important. I also help clients establish trusts to establish a secure and regular income for loved ones left behind. Trusts provide a steady income to the Beneficiary over the course of time, rather than distribution in a lump sum and allows the Trust to grow through investment. I am also skilled at drafting and executing wills, a person's declaration of how one wants their property dispersed after death. Because there are complex regulations regarding the validity of any will, it is important to hire an attorney with knowledge and experience. Estate Planning- I handle a variety of estate planning matters, including planning for the distribution of an individual's property at his or her death. My clients have worked hard to develop their assets and establish their independence and I use various tools to protect their assets. Wills, trusts, living wills, powers of attorney, guardianships and conservatorships are different ways to ensure their financial protection and personal well-being. I am also knowledgeable in the laws governing relationships between debtors and creditors, in case my clients have unfinished business when they commence estate preparation. - Professional Malpractice Law
