Firm Overview

DAVID R. HARTWIG, ESQ.

My practice is dedicated to the individual, who always receives close personal service. Experience has taught me that the only way to help my clients reach their goals is to establish relationships that focus on communication. I offer regular updates and report changes timely, as it is important that my clients understand the process. I take time to explain that process and explore how it may impact their case. I care about my clients and handle their matters with simple respect and sensitivity.

My clients consult me for advice and representation in matters of: mediation; family law, including divorce, custody, support, paternity, adoption, and changes after divorce; social security disability, both initial and continuing disability; personal injury and property damagesprobate and estate administration; creditor and debtor matters; collection of debts; estate planningwills and trustsprofessional malpractice; and in many types of small business and individual litigation.

I do not limit my practice in areas of law because it is the individual who is important; people's needs do not always fall into clearly delineated legal areas. There often arises a need to go into areas beyond the immediate concerns of a particular person's case and to consider future consequences. My practice is geared to the needs and desires of the individual in the future as well as the present.

My philosophy is to counsel clients so as to avoid litigation. The simplest and most overlooked way to avoid costly litigation is to practice preventative lawyering. With organization, analytical thinking, and creativity, I guide my client in seeking current resolution of legal matters with a low risk of future litigation. By taking the time to identify potential problems, my clients can be more confident in their results.

But when litigation arises, I actively communicate with, and involve, my clients in the process while I prosecute their cases.

Mediation is an alternative to trial; some courts impose mediation on litigants. With the help of an impartial trained Mediator the parties work through their differences and negotiate a final settlement. That agreement may be as enforceable as if the judge had ruled but the process may be quicker and less expensive -- it allows the parties ownership of the outcome.

Another alternative to litigation I offer is collaborative law. This process allows the parties in disputes to resolve the conflict themselves with the assistance of their lawyers. Unlike mediation or trial, there is usually no third party involved. The strategy is cooperative rather than adversarial and most participants reach a successful agreement. The process may be less expensive, there is no threat of litigation and fighting in court, and the participants completely control the proceedings with the security and comfort of having their own counsel intimately involved. Collaborative law is new, successful, and may lead to a better result than litigation because the solution is "win-win."

Regardless of whether they choose mediation, collaborative law, or traditional litigation, my clients always receive close personal service. Experience has taught me that the only way to help my clients reach their goals is to establish relationships that focus on communication. I offer regular updates and report changes timely. As it is important that my clients understand the process. I take time to explain that process and explore how it may impact their case. I care about my clients and handle their matters with simple respect and sensitivity.

I offer personal service, alternatives to trial, quality representation, and personal insight into the needs of my clients. I encourage you to learn more about my practice areas, my credentials, or to contact me. No matter what legal problem you face, it is important to hire a skilled attorney who takes the time to understand your goals. I look forward to hearing from you.
